my pistons on my M38 engine L-134 the piston have .040 on them would that be a indication that this engine might have been rebuild once before.

yes and was bored .040 oversized, good chance the crank was turned too.

It may have been rebuilt more than once. It is not necessary, unless it had serious damage to bore cylinders to 3rd or 4th oversize from std.
