Is this top really a NOS M38 top?

Could well be. It looks a bit short for the full length of the tub.

The distance between the half top back and the top of the window opening is different between the two photos, and I do not see that kicked up diagonal section on the flat piece.
Also, is not the reinforcement across the middle for the front bow?

I would suggest you ask the seller a simple question. What is the length of the top?

M38 top installed.

The military tops are angular in construction. The civilian have the arched openings.
Unless your talking about some of the militarized CJ vehicles but that is getting picky.

Ya it is a bit long for a half cab. I still think it's a 3A top.

The removeable rear panel makes it non-M38.
Your last pic Bretto looks spot on.

That photo is a CJ3A convertable top. It converts from full top to half top. That is not what you see on your ebay sale.

When you remove the two side curtains and the rear curtain you get this. If you remove the remaining rear top half you have a simple half top.

The CJ3A & 3B use the same top. Here's the standard factory style canvas top. This is the style on your Ebay sale.

Agree. I has the retainer flaps for the rear vertical bows on each corner.
